1. Purchase Orders

The possibility of placing purchase orders on the SITE is reserved exclusively for adults (in possession of the legal capacity to act) and who have carried out the required registration procedures. Pursuant to Legislative Decree 9 April 2003, n. 70 containing provisions on electronic commerce, the user who intends to proceed with the purchase of the products must express this intention through a request made directly on the SITE where, following the procedures indicated therein, he will forward his purchase order and the related payment. Once the purchase order issued by the user has been received, Tregalli di Andrea Ruggeri will send the latter an e-mail, to the e-mail address indicated, as confirmation of the order. Once the purchase order has been confirmed, the buyer can check the details at any time by accessing his account.

2. Prices, tariffs and shipping costs

The prices of the products are those actually displayed on the SITE at the time the order is issued by the user and are expressed in Euros (€). The prices of the products that appear on the SITE, unless otherwise specified, are inclusive of VAT. Shipping costs and any other additional costs, inclusive of VAT and expressed in Euros (€), will be duly highlighted and separately indicated in the order form before the user proceeds to confirm it. Tregalli di Andrea Ruggeri reserves the right to change its prices at any time, but the products will be billed on the basis of the rates in effect at the time the orders are stored. The products will remain the property of Tregalli di Andrea Ruggeri until the user has paid the purchase price, shipping costs and any other additional costs.

3. Returns

A) The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except for the cases of exclusion provided for in point IV below. To exercise this right, the Customer must send Tregalli di Andrea Ruggeri communication by registered letter with return receipt, addressed to:

Once the communication has been received, the Tregalli di Andrea Ruggeri Customer Service will open a case for the management of the return and communicate to the Customer the instructions on how to return the Products, which will take place via courier indicated by Tregalli di Andrea Ruggeri itself.
The right of withdrawal is governed by the following conditions:

I. The law applies to the Product purchased in its entirety; therefore if the Product is made up of several components or parts it is not possible to exercise the withdrawal only on part of the Product purchased.
II. In case of exercise of the right of withdrawal, Tregalli di Andrea Ruggeri will refund the customer the full amount of the returned goods, including shipping costs where applicable, within 14 days from the date on which the communication of withdrawal was received, without prejudice to the right di Tregalli di Andrea Ruggeri to suspend the payment of the refund until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer, unless the latter has expressly requested a different method. In case of bank transfer or cash on delivery, it will be the Customer's responsibility to provide the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN).
III. Also in order to be able to guarantee the free return pursuant to article 8 below, the Products must be returned in the same box in which they were received.
IV. In addition to the cases indicated in the Introduction (non-consumer customer and/or requesting an invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 legislative decree 21/2014:

- order of Products made to measure or clearly personalized;
- ordering Products that are liable to deteriorate or expire rapidly;
- order of sealed Products which do not lend themselves to being returned for hygienic or health protection reasons or which have been opened after delivery.

With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that the Products that "risk of deteriorating or expiring rapidly" include both all Food Products (including wines, spirits and beverages) and cosmetics , as the characteristics and qualities of these types of Products are subject to alteration also as a result of inappropriate storage. Therefore, for hygienic and customer protection reasons, the right of withdrawal is applicable only for Products purchased on the Site which can be returned to Tregalli di Andrea Ruggeri and put back on the market without endangering the health of consumers (such as books, gadgets, kitchen utensils, etc.).

B) Pursuant to art. 14 of Regulation 524/2013, the user is informed that in the event of a dispute, he may file a complaint via the European Union ODR platform which can be reached at the following link http://ec.europa.eu/consumers/odr/ (the platform has been operational since 15 February 2016). The ODR platform is an access point for users who wish to resolve disputes arising from online sales or service contracts out of court.

4. Availability of products and services

The products offered on the SITE are limited in number. It may therefore happen, also due to the possibility that several users purchase the same product at the same time, that the ordered product is no longer available after the transmission of the purchase order. In the event of total or partial non-availability of the product or service upon receipt of the order, the user will be informed by e-mail with the proposal to:

•delivery of a partial order, with refund of the missing product;
•replacement of the missing product with one of similar or superior characteristics
•cancellation of the order with full refund.

If the user chooses to be refunded, Tregalli di Andrea Ruggeri will refund within 15 days of the request. The refunded sum will be equal to the amount paid, including shipping costs. Any credit delays may depend on the bank, the type of credit card or the payment solution used. In case of impossibility to re-credit the amount on the credit card or on the payment solution adopted by the customer, the refund will be made by bank transfer, upon communication by the user of the relative coordinates and IBAN code. Neither party will be responsible for the failure of the order in the event of force majeure, i.e. strike, natural disaster, terrorist attack, war, problems affecting suppliers, transport or production, measures taken by public authorities and the like. In the cases listed above, both parties are entitled to a reasonable additional period to fulfill their obligations. However, if the circumstances in question last more than 60 days, the buyer may cancel the order by written notice to the supplier.

5. Delivery of products

Deliveries will be made in the territories indicated on the website www.tregalli.it, in the shopping cart section. The indicative delivery times for each product will be specifically indicated during the purchase procedure and, in any case, before its completion. They will also be indicated in the SHIPPING section of the SITE. The delivery of the purchased products can take place, at the user's choice:

• to the postal address indicated by the user as domicile;
•alternative postal address, requested in the order form.

6. Shipping

The shipment is made when all the purchased items are available. The costs, to be paid by the buyer, are calculated automatically by our Ecommerce system according to the destination and the weight of the goods.
On delivery of the products to the courier, they will be sent to user an e-mail confirming the shipment in which the tracking number will be indicated through which he will be able to verify the status of the shipment. Each delivery is considered completed from the moment in which the courier makes the products available to the buyer, according to what results from the system used by the carrier to track shipments.

7. Payment

The accepted cards are all those belonging to the CartaSi, Visa, Visa Electron, MasterCard, American Express circuits. Credit card data is entered directly on the pages of Tregalli di Andrea Ruggeri's banking partner, and is transmitted to the bank's servers in encrypted form according to the 128-bit SSL (Secure Socket Layer) standard, one of the most advanced protection systems and effective currently available. For greater security, only the banking partner has access to the data of the card used for payment, while Tregalli di Andrea Ruggeri has no possibility of knowing or storing such data. Each user guarantees that he is authorized to use a credit card or his PayPal account to pay for the Order and that these means of payment allow access to sufficient funds to cover all costs relating to purchases of products through the SITE .

8. Protection of personal data

Tregalli di Andrea Ruggeri guarantees the user that the personal data acquired in relation to the sale of the products will always be processed lawfully and correctly, in full compliance with the provisions of Legislative Decree 30 June 2003, no. 196. For any information relating to the processing of personal data, please refer to the "Privacy Policy" section and to the information on data processing provided by Tregalli di Andrea Ruggeri, pursuant to art. 13 of Legislative Decree 196/2003, to the user when registering on the SITE. The user guarantees that the personal information provided during the registration procedure on the Site is complete and truthful. The user agrees to hold Tregalli di Andrea Ruggeri harmless from any compensation obligation and/or sanction deriving from and/or in any way connected to the violation by the user of the rules on registration on the Site.

9. Effectiveness and modification of the General Conditions of Sale

These General Conditions of Sale apply to all sales made on the SITE and can be modified at any time. Any modifications and/or new conditions will be effective from the moment of their publication in the "Conditions of sale" section of the SITE. The applicable General Conditions of Sale are those in force on the date the purchase order is sent.
These General Conditions of Sale do not regulate the sale of products and/or the supply of services by subjects other than Tregalli di Andrea Ruggeri who are present on the SITE through links, banners or other hypertext links. Tregalli di Andrea Ruggeri is therefore not responsible for the contents of these sites or for any errors and/or omissions and/or violations of the law by them.
